1. Introduction

Welcome to TakeFlight Digital Ltd ("we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of our website, software platform, digital products, and services provided through www.takeflight.digital (the “Site”), including but not limited to:

- TakeFlight Standard, Pro, and Business SaaS subscriptions (including all templates)

- Authority Advantage Fast Track funnel-building service.

- Content services (e.g. Content Pack)

- Digital downloads (e.g. Authority Advantage, AI Prompts for Property, TakeFlight AI)

By accessing or using our Site, services, or purchasing any product, you agree to be bound by these Terms. If you do not agree, please do not use the Site or purchase our products or services.

These Terms apply to all users, including customers, visitors, and anyone accessing or interacting with our products and services.

2. Subscription Services & Payments

2.1 Subscription Plans

We offer subscription access to our all-in-one sales and marketing platform under the following plans:

TakeFlight Standard

TakeFlight Pro

TakeFlight Business (contracts may apply)

Each plan includes a recurring monthly or annual fee, depending on your selection at checkout. Your subscription will automatically renew unless cancelled in accordance with these Terms.


2.2 Billing & Payment Processing

All payments are securely processed via Stripe. By subscribing or purchasing from us, you authorise us (via Stripe) to charge your selected payment method on a recurring basis until you cancel.

You can manage your billing information and view/download invoices directly within your TakeFlight account under Settings → Billing.


2.3 Cancellations & Access

You may cancel your subscription at any time by visiting your billing dashboard or contacting [email protected].

Cancellations take effect at the end of your current billing cycle. You’ll retain full access to the platform until your billing period ends. No partial refunds are offered for mid-cycle cancellations.


2.4 Refund Policy

We do not offer refunds on subscription payments.


You are responsible for cancelling your plan if you no longer wish to be billed.

Authority Advantage Fast Track:
This is a bespoke, done-for-you service. As such, Authority Advantage Fast Track is non-refundable once purchased.

ACCELER8 Implementation:
This is a bespoke, done-for-you service. As such, ACCELER8 is non-refundable once purchased.

Digital Products (e.g. Authority Advantage, AI Prompts):
All digital downloads are non-refundable due to their immediate access nature.


2.5 Failed Payments & Account Suspension

If your payment fails, you’ll be notified and your account will be paused until you update your payment method. Continued non-payment may result in suspension of your account and data access.

3. User Conduct & Restrictions

3.1 Acceptable Use

By using the TakeFlight platform or any of our services, you agree to use them only for lawful purposes and in a way that does not:

- Violate any applicable laws or regulations

- Infringe on the rights of others

- Disrupt or interfere with the functionality, security, or integrity of our platform or services

- Attempt to gain unauthorised access to any part of the system or other users’ data


3.2 Prohibited Use

You may not use the platform or services to:

- Spam, scam, or send unsolicited messages

- Misrepresent your identity or impersonate another individual or organisation

- Distribute viruses, malware, or other harmful content

- Engage in any activity that damages our reputation, services, or platform


3.3 Account Access & Security

You are responsible for maintaining the confidentiality of your login details. You must not share your account with anyone outside your organisation (unless permitted by your plan tier). You agree to notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate access if we believe you’ve breached these terms.


3.4 No Resale or Redistribution

You may not resell, license, or redistribute access to the TakeFlight platform, templates, AI tools, or other assets without our explicit written consent.

4. Intellectual Property & Licensing

4.1 Ownership of Materials

All content, templates, software, visuals, branding elements, automations, systems, AI tools, and documentation provided through the TakeFlight platform and services are the intellectual property of TakeFlight Digital Ltd.

These materials are protected by copyright, trademark, and other applicable UK and international intellectual property laws.

You do not acquire any ownership rights by using or purchasing access to our services.


4.2 Personal Licence to Use

When you subscribe to a TakeFlight plan or purchase a digital product, you are granted a non-exclusive, non-transferable licence to use the product or service for your individual or business use only.

You may not:

- Reproduce, distribute, or share any part of the system outside your organisation

- Modify or repurpose templates or tools for resale

- Use our training materials, strategies, or frameworks to build or sell competing services

- Extract source code, reverse-engineer, or attempt to replicate platform functionality for redistribution


4.3 Content Ownership (User Content)

You retain full ownership of any content, data, or materials you upload or create within your account.

However, by using our platform, you grant us a limited licence to access and process your data solely for the purpose of delivering and improving the services.


4.4 AI Content & Prompts

While our AI tools assist with content creation, you are responsible for reviewing and approving any copy or outputs before use. TakeFlight is not liable for any inaccuracies or misuse of AI-generated content.


4.5 Brand & Trademarks

All logos, product names, taglines, and visuals associated with TakeFlight are trademarks of TakeFlight Digital Ltd. You may not use our branding without written permission.

5. Disclaimers & Limitation of Liability

5.1 No Guarantees of Results

TakeFlight Digital Ltd provides tools, training, and services designed to support the growth and efficiency of property professionals. However, we make no guarantees regarding the specific results, outcomes, or business performance improvements you may achieve.

Your results may vary depending on a range of factors, including your implementation, market conditions, business model, and level of effort.


5.2 Platform Access & Downtime

While we strive to maintain high uptime and performance, we do not guarantee uninterrupted access to the TakeFlight platform or any of its features. We are not liable for:

- Planned or unplanned maintenance

- Third-party service outages (e.g. email/SMS providers)

- Interruptions due to internet or hosting issues

- We’ll do our best to notify users of any significant downtime or disruptions.


5.3 Limitation of Liability

To the fullest extent permitted by law, TakeFlight Digital Ltd, its directors, employees, and partners shall not be liable for:

- Any indirect, incidental, or consequential damages

- Loss of business, revenue, or data

- Claims arising from user error, misuse, or unauthorised access

In any event, our total liability shall not exceed the total amount paid by you to TakeFlight in the 12 months preceding the claim.


5.4 Third-Party Integrations

Our platform may integrate with third-party tools and services (e.g. Stripe, WhatsApp, Google). We are not responsible for the functionality, availability, or data handling of these external platforms. Use of third-party tools is subject to their own terms.

6. Data Protection & Privacy

6.1 Data Protection Commitment (GDPR)

TakeFlight Digital Ltd is fully committed to protecting your personal data in line with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

We only collect and process data that is necessary to deliver and improve our services, and we never sell or share your data with third parties for marketing purposes.


6.2 What Data We Collect

We may collect and store:

- Your name, email address, and contact information

- Business and payment details

- User activity and usage data within the platform

- Customer information you upload (e.g. CRM records, messages)

- This information is used to deliver services, provide support, and improve functionality.


6.3 Data Storage & Security

All data is securely stored using industry-standard encryption and access controls. Our platform is hosted on reliable cloud infrastructure, and sensitive data (such as passwords and payment info) is encrypted in transit and at rest.

Your payment details are handled via Stripe — we do not store or have access to full card details at any time.


6.4 Your Rights

You have the right to:

- Access the personal data we hold about you

- Request corrections to inaccurate data

- Request deletion of your data (subject to legal obligations)

- Withdraw consent or object to certain types of data processing

6.5 Client Data Responsibility

If you upload or manage customer/client data inside your TakeFlight account (e.g. lead data, communications, booking info), you are the data controller for that data and are responsible for complying with GDPR requirements in your own business.

We act as a data processor and handle your clients' data solely for the purpose of delivering our services.


6.6 Cookie Usage

Our website uses cookies to:

- Improve your browsing experience

- Understand usage patterns

- Enable essential functionality

6.7 Data Retention
